Terms of service

Introduction

Welcome to BigWishes (“BigWishes,” “we,” “our,” or “us”), a gifting platform available at https://bigwishes.fans, operated by BigWishes LTD, a private limited liability company incorporated in Cyprus, with registered office at Archiepiskopou Makariou III, 140 RAPTOPOULOS BUILDING 3021, Limassol, Cyprus, registration number HE 452670.

To handle global payments, BigWishes LTD has appointed regional payment agents:

  • For gifters in the United States or Canada, payments are processed by BigWishes Inc., a company incorporated in the United States, acting as an authorized payment agent.
  • For gifters in the European Union and all other countries, payments are processed by BigWishes LTD, a company incorporated in Cyprus.

These Terms of Service (“Terms”) govern your access to and use of the Platform. By continuing to use the Platform, you agree to be bound by these Terms.

1. Definitions

  • Creator: An invitation-only, verified account holder who maintains a wishlist and receives gifts from gifters.
  • Gifter: An anonymous account holder who voluntarily sends a gift to a creator via the Platform.
  • Wish: A specific item listed by a creator on their wishlist, which may include physical products or custom monetary goals.
  • Gift: The monetary amount a gifter sends toward a specific wish.
  • Services: Access to and use of the Platform, including anonymous account creation, wishlist viewing, and sending a gift.
  • Payment Processor: A third-party service that handles payment transactions on behalf of BigWishes.
  • User: Any individual or entity accessing or interacting with the Platform, including gifters and creators.

2. Eligibility and Age Restrictions

To use BigWishes, you must:

  • Be at least 18 years old, or the legal age of majority in your country of residence, whichever is higher.
  • Be fully legally capable to enter into legally binding agreements.
  • Not be barred from using the Platform under any applicable law or regulation.

BigWishes does not knowingly collect or solicit information from anyone under the age of 18.

3. Nature of BigWishes services

BigWishes is a platform that lets gifters voluntarily send gifts to creators:

  • Creators list desired items or custom monetary goals.
  • Gifters may send monetary gifts toward those goals.
  • These are not commercial transactions; there is no exchange of goods, services, or other consideration provided in return.

Gifts are non-refundable, voluntary, and made without expectation of reciprocity.

4. Account registration and security

4.1 Gifter accounts: Sign-up takes one click. BigWishes generates a 16-digit AnonID. We do not collect a name, email, phone, or any other identifying detail. Your AnonID is your only way to sign back in. We have no recovery: if you lose it, the account is gone.

4.2 Creator accounts: Creator and agency accounts are invitation-only. Creator wishlist setup, profile information, and payout connection are handled by our team during onboarding. We confirm identity and 18+ before any account can receive gifts.

4.3 Account security: You are responsible for safeguarding your AnonID (gifters) or sign-in credentials (creators). Sharing, selling, or allowing others to access your account is strictly prohibited.

5. Billing, payment, fees, taxes, and payout

5.1 Fee structure

Every gift sent through the Platform is subject to a platform service fee. BigWishes reserves the right to update its fee structure at its discretion.

5.2 Payment processing

All transactions are handled by approved third-party payment processors and on-chain transfers. BigWishes does not collect or store credit card or banking information.

5.3 Currency and conversion

Transactions are quoted in USD-pegged stablecoin (USDT) unless stated otherwise. Wallet providers or banks may apply additional foreign exchange or network fees.

5.4 Payouts to creators

Only verified creators are eligible to receive payouts. Funds awaiting payout are held in segregated accounts maintained exclusively for the benefit of creators. Payouts are executed through a licensed third-party payment institution.

Creators are required to request payout of available funds within one hundred eighty (180) days from the date such funds become eligible for payout.

5.5 Taxes

Each user is responsible for complying with their own tax obligations. Creators are solely responsible for reporting and paying any applicable taxes on gifts received.

5.6 Refunds and errors

All gifts are final and non-refundable unless required by law or approved by BigWishes at its sole discretion.

5.7 Service availability and payment methods

BigWishes may determine and update available payment methods at its discretion without notice. At the date of this document, BigWishes accepts TRC20 USDT only.

6. User content and communications

By submitting user content, you confirm that:

  • You own or have the legal right to post such content.
  • Your content does not violate any third-party rights, applicable laws, or these Terms.

Prohibited content includes anything illegal, obscene, defamatory, infringing, threatening, or harassing. BigWishes reserves the right to monitor, review, or remove user content at any time.

7. Wishlists and gifter contributions

BigWishes provides a platform where creators can publish and share wishlists. Creators are solely responsible for curating their wishlist content. When a gifter sends a gift toward a specific wish:

  • The gift is voluntary; it is not a purchase of goods or services.
  • BigWishes does not sell, source, ship, or guarantee the delivery or fulfillment of any listed wish.
  • All gifts are final and non-refundable, unless required by law.

8. Prohibited Activities

You agree not to engage in:

  • Using the Platform illegally, fraudulently, or deceptively.
  • Violating any local, national, or international law or regulation.
  • Promoting or facilitating criminal activity or illegal goods or services.
  • Uploading content that is defamatory, harassing, obscene, pornographic, or offensive.
  • Displaying or distributing nudity, pornography, or sexually explicit content.
  • Transmitting viruses, malware, or harmful software.
  • Creating wishlists that include prohibited items (alcohol, tobacco, firearms, controlled substances, live animals).

9. Third-party websites

The Platform may include links to third-party websites for your convenience and reference. BigWishes has no control over third-party websites and is not responsible for their availability, accuracy, or content.

10. Intellectual property

All rights, title, and interest in and to the Platform are the exclusive property of BigWishes or its licensors. Users retain ownership of content they submit to the Platform. By posting user content, you grant BigWishes a worldwide, non-exclusive, royalty-free license to use your content in connection with the operation and promotion of the Platform.

11. Copyright complaints and takedown requests

If you believe that content on the Platform infringes your copyright, submit a notification to: legal@bigwishes.fans. Your notification should include identification of the copyrighted work, location on the Platform, your contact information, and a statement of good faith belief.

12. Privacy and data protection

BigWishes complies with the General Data Protection Regulation (EU) 2016/679 (GDPR). Our data practices are governed by our Privacy policy and Anonymity policy, which both form part of these Terms.

13. Termination and suspension

We may suspend or terminate your access if:

  • You breach these Terms.
  • You engage in conduct that harms us, our Users, or third parties.
  • Your actions are unlawful or violate community standards.
  • Required by law or regulatory authorities.

14. Limitation of liability

The Platform and Services are provided “as is” without warranties of any kind. BigWishes is not liable for indirect, incidental, special, punitive, or consequential damages. In no event shall BigWishes’s aggregate liability exceed €100.

15. Representations and warranties

You represent and warrant that you have the legal capacity to enter into these Terms, your use complies with applicable laws, and any information you provide is accurate.

16. Indemnification

You agree to indemnify and hold harmless BigWishes LTD from claims arising from your use or misuse of the Platform, any breach of these Terms, your user content, or your failure to comply with tax or regulatory obligations.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Cyprus. Any dispute shall be subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus.

18. Modifications to these Terms

We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms.

19. Miscellaneous

  • Force majeure: BigWishes shall not be held liable for delays resulting from causes beyond its reasonable control.
  • Assignment: We may assign our rights and obligations without restriction. You may not transfer yours without our consent.
  • Severability: If any provision is found unenforceable, the remaining provisions shall remain in effect.
  • No waiver: Our failure to enforce any provision shall not constitute a waiver of such rights.
